These Terms of Service ("Terms") govern your access to and use of PionaMood and related websites, apps, and services (collectively, the "Service"). The Service is operated by Erzhidian Technology Co., Ltd. ("PionaMood", "we", "us", or "our"). By using the Service, you agree to these Terms.

1. Service Description

PionaMood provides AI emotional companionship, mood reflection, guided self-care tools, journaling, mindfulness, breathing, grounding, ambient sound, thought reframing, and personalized report features. The web experience primarily provides information about the app and guides users to download or access the mobile app.

2. Important Health and Safety Disclaimer

PionaMood is for general wellbeing, education, self-reflection, and personal organization. It does not provide medical advice, clinical diagnosis, psychiatric treatment, psychotherapy, crisis intervention, medication guidance, or emergency services.

AI-generated content, reports, and suggestions may be inaccurate or incomplete and should not be treated as professional advice. You are responsible for deciding whether and how to use any information from the Service.

If you are in immediate danger, considering self-harm or suicide, may harm someone else, or are experiencing a medical or mental health emergency, contact local emergency services or a qualified professional immediately.

3. Eligibility

You must be at least 13 years old, or the minimum age required in your country or region, to use the Service. If you are under the age of majority, you may use the Service only with permission and supervision from a parent or legal guardian.

4. Accounts and Security

Some features require an account or third-party login, such as Apple Sign-In or Google Sign-In. You agree to provide accurate information, keep your credentials secure, and promptly notify us of unauthorized account use.

We may refuse, suspend, or terminate access if we reasonably believe that an account is being used unlawfully, unsafely, fraudulently, abusively, or in violation of these Terms.

5. Subscriptions, Purchases, and Paid Features

PionaMood may offer subscriptions, lifetime access, or other paid digital features.

  • Mobile purchases are processed by Apple App Store or Google Play, not directly by us.
  • Subscription pricing, renewal, cancellation, trial, tax, and refund rules are controlled by the applicable app store and shown at the point of purchase.
  • Unless canceled at least 24 hours before the end of the current period, auto-renewing subscriptions may renew through your app store account.
  • You can manage or cancel subscriptions through Apple App Store or Google Play account settings.
  • We do not store full payment card details.
  • Deleting the app or deleting your PionaMood account may not automatically cancel an app store subscription. You must cancel through Apple or Google if you no longer want renewal.

Refund requests for app store purchases are handled under Apple App Store or Google Play policies unless applicable law requires otherwise.

6. User Content

"User Content" means information you submit, create, or generate through the Service, including mood records, chat messages, journal entries, feedback, profile inputs, and report inputs.

You retain ownership of your User Content. You grant us a limited, worldwide, non-exclusive license to host, store, process, transmit, display, and use User Content only as needed to provide, maintain, secure, and improve the Service, comply with law, and enforce these Terms.

You are responsible for your User Content and must not submit content that is unlawful, abusive, harassing, exploitative, hateful, sexually explicit involving minors, infringing, malicious, or intended to harm others or disrupt the Service.

7. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, deceptive, abusive, or infringing purposes.
  • Attempt to access another user's account or data.
  • Reverse engineer, scrape, overload, attack, or interfere with the Service.
  • Bypass subscriptions, usage limits, entitlement checks, safety controls, or security measures.
  • Use the Service to generate or distribute harmful instructions, harassment, spam, malware, or content that violates applicable law.
  • Represent AI outputs as professional medical, legal, financial, or mental health advice.

8. AI Features

The Service may use AI systems to generate reports, chat responses, summaries, and tool recommendations. AI outputs are generated automatically and may not reflect our views. We do not guarantee that AI outputs are accurate, complete, safe, or suitable for your circumstances.

You should independently evaluate AI outputs before relying on them. For health, mental health, legal, financial, safety, or other high-impact decisions, consult a qualified professional.

9. Intellectual Property

The Service, including software, interface design, graphics, text, prompts, workflows, trademarks, logos, and other materials, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own lawful, non-commercial purposes.

10. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and delete information. By using the Service, you acknowledge that we process information as described in the Privacy Policy.

11. Account Deletion and Termination

You may request account deletion in the app through:

You may also request deletion outside the app by emailing support@pionamood.com or visiting Account Deletion Request.

We may suspend or terminate access to the Service if you violate these Terms, create legal or security risk, misuse the Service, or if continued operation becomes impractical. Termination does not automatically cancel app store subscriptions, and it does not affect obligations that should reasonably survive termination.

12. Third-Party Services

The Service may integrate with third-party services such as Apple, Google, RevenueCat, Cloudflare, Sentry, Firebase/Google Analytics, AI model/API providers, and app store services. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services except as required by law.

13. Availability and Changes

We may modify, suspend, or discontinue parts of the Service at any time. We may also update features, eligibility, pricing, usage limits, AI providers, supported platforms, or these Terms. We will provide notice when required by law.

14. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

15. Limitation of Liability

To the fullest extent permitted by law, PionaMood and Erzhidian Technology Co., Ltd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, service interruption, emotional distress, or reliance on AI-generated content. Our total liability for any claim relating to the Service will be limited to the greater of the amount you paid to us for the Service in the 12 months before the claim or USD 50, unless applicable law requires otherwise.

16. Governing Law and Disputes

These Terms are governed by the laws applicable to the operating entity of PionaMood, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your jurisdiction provide otherwise. The parties will first try to resolve disputes through good-faith communication.
